Tower View to Deva Way, Caia Park, Wrexham – Gating Order 2010

NOTICE OF PROPOSALS
(Regulation 3 The Highways Act 1980 Gating Orders) (Wales) Regulations 2007)

Wrexham County Borough Council proposes to make a Gating Order under Section 129A (1) Highways Act 1980 (“the Act”) and of all other enabling powers the effect of which will be to restrict by means of gates and to all persons (subject to exceptions described below) the public right of way over the footpath which forms part of the highway between Tower View and Deva Way, Caia Park, Wrexham (“the highway”) at any time.

The highway is shown between Points A and B on the plan annexed to this Notice. The Ordnance Survey Grid Reference for Point A is SJ505346 and for Point B is SJ506347.

The proposed restricted use of the highway shall not apply to any person who lives or carries on a business in 37, 38, 39, 41, 43, 45, 46, 47, 48, 49, 50, 51, 52, 53, 54, 55, 56, 57, 58 Tower View as premises adjoining or adjacent to the highway, to any police, ambulance or fire service personnel acting in pursuance of statutory powers and duties, to any duly authorised Officer of Wrexham County Borough Council or to any statutory undertaker, gas, electricity, water or communications provider requiring access to their apparatus situated in the highway. In the event that the Gating Order is made, such persons will be afforded access to the highway by Wrexham County Borough Council.

The alternative route for pedestrians should the highway become restricted by the making of the Gating Order is via Tower View, Cranford Road and Deva Way, Caia Park, Wrexham as shown by the solid black line on the plan annexed to this Order.

Objections to the proposed Gating Order, together with the grounds upon which they are made, should be sent in writing to the Chief Transportation and Asset Management Officer, Wrexham County Borough Council, Crown Buildings, 31 Chester Street, Wrexham LL13 8PG no later than 28 days from the date of this Notice.

A copy of the proposed Gating Order together with the plan showing the length of highway to be restricted and an alternative route for pedestrians to which the proposed Gating Order relates may be examined at Wrexham County Borough Council Offices, Crown Buildings, 31 Chester Street, Wrexham LL13 8PG Monday – Friday 9.00am – 5.00pm (4.45pm on Fridays).
