I don't want to vote
The Electoral Registration Officer has a duty under the Representation of the People Act 1983 to maintain an accurate register of electors.
Every year the Electoral Registration Officer is required to undertake an annual review of all properties within the county. This takes into account that persons are resident at an address on the 15th October each year. Persons details are added to the register after we are satisfied that they are:
- Resident at the address in question and
- That the person is eligible under Section 4 of the Representations of the People Act 1983.
A person is eligible to be included in the register of electors for an address if they are Citizens of The United Kingdom, Republic of Ireland, Commonwealth Member Country or European Union Member State.
Regulation 35 of the Representation of the People Regulations 2001 authorises the Electoral Registration Officer to inspect any records kept by the council that appointed him in whatever form they are kept to assist him with his duties of registering electors. After reviewing other records the Electoral Registration Officer will make a decision on whether a persons details should be included in the register.
The Register of Electors is also produced in accordance Section 3 of the Juries Act 1974, it is utilised by Her Majesty’s Court Service for the purpose of summoning jurors. It must therefore be accurate, correct and comprehensive to ensure that Jury’s reflect a full cross section of the electorate.
The decision regarding inclusion of individuals as electors in the register is a decision taken by the Electoral Registration Officer under current legislation not by the individual in question. It is an offence to withhold information from the Electoral Registration Officer with a maximum fine of £1000 for non-compliance.
The Registration of Electors is not optional, however it is open to you not to vote if you so wish. A poll card is sent to each eligible adult on the Electoral Register.
