A tenant who has caused misery for his neighbours was evicted after a Judge agreed with Wrexham Council that the tenant should suffer the ultimate punishment and lose his home.
Neighbours in the Stansty area of Wrexham had complained of loud music, late night parties and had even been threatened by the tenant, Julian Spring, who ignored their misery and continued to behave in a manner that was an anti social nuisance.
The Housing and Public Protection Department’s Tenancy Enforcement Team investigated the complaints. With the help of neighbours in the affected area they gathered evidence of the misery they had to endure as a result of Mr Spring’s anti social behaviour.
The case appeared at Wrexham County Court earlier in the year when the Judge gave Mr Spring one final chance to improve his behaviour and awarded a Postponed Order for eviction and an injunction against the tenant forbidding him from engaging in anti social behaviour.
Despite this opportunity, complaints continued to be made of his anti social behaviour and the case was placed before the County Court again. A group of local residents and the Tenancy Enforcement Team gave evidence, and this time the Judge decided that enough chances had been given and that Mr Spring should lose his home. He was evicted last Monday.
Landlord Services Manager, Fred Czulowski, said:
"Eviction is always a final resort, however, in this case it was the only option available after all other attempts to make the tenant behave in an acceptable manner had failed. Neighbours were fully supportive of our action and have bravely stood together to provide evidence in order to make sure the eviction notice was successful."
Stansty Councillor David I Bithell, said:
"This is very good news for the residents in the Stansty area who have had to endure years of misery because of this tenants’ anti social behaviour. I would like to thank the residents affected who have cooperated fully with us in order to achieve this successful eviction. My thanks also go to Tenancy Enforcement staff who have worked extremely hard both to try to resolve the problems then to secure the eviction when everything else had failed."
Lead Member for Housing and Planning, Cllr Mark Pritchard, said:
"This eviction sends out a clear message to tenants that we will not hesitate to use every means available to us, including eviction, to ensure that anti social behaviour does not blight our communities. I would advise any tenant whose behaviour is affecting the peace and quiet of others to take very seriously the fact that, unless they change their behaviour and stop being a nuisance to others, eviction may be the end result for them. Everyone has a right to live in peace and quiet in their own home and I believe in a zero tolerance approach to anyone who disturbs that peace."
