Fixed Penalty Notices for Unauthorised Absence from School
Sections 444A and 444B of the Education Act 1996 allows Local Authorities to apply a Fixed Penalty notice of up to £120 for certain cases of unauthorised absence from school.
The Head teacher of any Local Authority school can apply for a Fixed Penalty Notice of £60 (rising to £120 if the original notice remains unpaid after 28 days) when any pupil of statutory school age has:
- Been absent from school for more than 5 school days in any term and this absence has not been authorised by the Head teacher. These days need not be consecutive.
- Is late arriving in school for more that 10 occasions in any one term
- Cases of persistent truancy from school.
Arrangements for payment will detailed on the penalty notice.

If the Fixed Penalty Notice remains unpaid after a period of 42 days the Local Authority may instigate a prosecution under Section 444 of the Education Act 1996.
